全文 | The Regulations Governing the Permitting and Management of Excess Processing Capacities of Industrial Waste Processing Facilities (hereinafter referred to as the Regulations) have not been reviewed and amended since its promulgation on 29 May 2002. To effectively expand industrial waste processing capacities and aim for flexible utilization of resources, the Regulations are to be amended. The main points of the amendments are summarized as follows: 1. To encourage enterprises to make the excess capacity of their processing facilities available and to streamline the permit application for excess processing capacity, provisions are added to allow those that have obtained permits to process waste by themselves or with other enterprises apply for simplified permit documents if the wastes to be processed are consistent with the originally permitted types of wastes. The provisions also stipulate the documents required for the permit application and the content to be listed on the permit document. (Amendments to Articles 3, 5, and 8) 2. Referencing the Permit Management Regulations for Public or Private Waste Clearance and Disposal Organizations, provisions on the duration, extension application, and cancellation of approved trial runs are added. (Amendment to Article 4) 3. A provision stipulating that the excess processing capacities applied for by enterprises cannot be more than 50% of the installed processing capacities is added. (Amendment to Article 7) 4. The term of excess capacity permits is extended from three years to five years. (Amendment to Article 9) 5. The requirement to reapply for the permits after expiration is changed to permit extension applications. Provisions on documents required for permit extension applications are also added. (Amendment to Article 10) 6. To streamline the application procedures for changes in enterprise excess capacity permits, a provision that allows changes other than basic information be applied for through the change application procedure without needing to re-apply for the permits is added.
